My understanding is that the MOFCOM catalogue says that frontier models meeting any of the three thresholds (eg FLOPs, parameters, leading global performance, which apply to models in the restricted category), if open-sourced in the future, will need to report to MOFCOM but will receive automatic licensing (对本类技术开源……适用自动许可等便利措施; see footnote 2 in the Word document MOFCOM provided).
The exemption for models already made public through open weights or published literature applies to frontier AI models that fall into the prohibited category (i.e., models trained on core data from China footnote 1).
Excellent work. I learned a lot! I retired last year and haven’t kept up. Wow things are changing so fast.
Great job. It’s always interesting to see the lengths Beijing will go to in order to buttress the façade of being a rule of law country.
